PERSONAL DATA PROTECTION NOTICE

AYJ Courier Service Sdn. Bhd. (hereinafter referred to as “AYJ”,” AYJ Courier”,” AYJ Courier Service”, “We”, “Our”, or “Us”) is committed in protecting the personal information of users (hereinafter also referred to as “user”, “you” or “your”) and will take necessary and relevant measures to safeguard your personal information in accordance with the Personal Data Protection Act 2010 (PDPA 2010).

This Personal Data Protection Notice (hereinafter referred to as “Notice”) governs the manner in which AYJ Courier Service collects, uses, maintains and discloses information collected from the users. This policy only applies to personal information of individuals that are processed for commercial transactions.

Collection of Personal Information

AYJ Courier Service does not collect any personal identifiable information when you visit our website (“Site”) or mobile application (“App”) unless you opt to provide that information to AYJ Courier Service and/or continue to proceed after being informed or notified by AYJ Courier Service that your information will be recorded. The following data that will be collected by AYJ Courier Service from you will be including but not limited to name, identification number, email address, phone number, address, bank account information and any other personal data as defined and described under PDPA 2010.

AYJ Courier Service will collect data and process data when the user:

1. Register online or place an order for any of our products or services.
2. Voluntarily complete a customer survey or provide feedback on any of our message boards or via email.
3. Use or view our website via your browser’s cookies.

Purpose of Data Collection:

AYJ Courier Service use the data we collect from you or the Shipper(s) will be used, or shared with third parties (including related companies, third party service providers, and third party sellers), including purposes of serving you, ensuring timely and successful deliveries to you, and improving our service quality to you and for some or all of the following purposes (where applicable):

1. Managing the administrative and business operations of AYJ Courier Service and complying with internal policies and procedures;
2. Performance of your delivery service;
3. Tracking and analytics of your delivery;
4. Notifying you regarding the status of your order or delivery and updating you on the progress of the same;
5. Contacting you for feedback after or during delivery;

• Responding to and handling your queries and requests;
• Conducting investigations relating to disputes, billing or fraud;
• Resolving complaints, problems or disputes;
• Facilitating any correspondence between the Shipper and you;
• Monitoring or recording phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation;
• Providing media announcements and responses;
• Conducting research and analytics to enable us to better understand your location, preferences, demographic, and to improve our service delivery and your customer experience at our respective touchpoints;
• Processing any insurance claims and payments that may arise under AYJ Courier

Service’s policies;

• Legal purposes (including but not limited to obtaining legal advice and dispute resolution);
• Accounting, risk management, compliance and record keeping purposes;
• Meeting or complying with any applicable rules, laws, regulations, codes of practice or guidelines issued by any legal or regulatory bodies which are binding on AYJ Courier Service;
• Purposes which are reasonably related to the aforesaid;
• To facilitate your use of the Services (as defined in the Terms of Use) and/or access to the Platform;
• To process orders, you submit through the Platform, whether the products are sold by AYJ Courier Service or a third-party seller. Payments that you make through the Platform for products, whether sold by AYJ Courier Service or a third-party seller, will be processed by our agent;
• To deliver the products you have purchased through the Platform, whether sold by AYJ Courier Service or a third-party seller. We may pass your personal information on to a third party in order to make delivery of the product to you (for example to our courier or supplier), whether the product is sold through the Platform by AYJ Courier Service or a third-party seller;
• To update you on the delivery of the products, whether sold through the Platform by AYJ Courier Service or a third-party seller, and for customer support purposes;
• To compare information, and verify with third parties in order to ensure that the information is accurate;
• Further, we will use the information you provide to administer your account (if any) with us; audit the downloading of data from the AYJ Courier Service’s platform; improve the layout and/or content of the pages of the AYJ Courier Service’s platform and customise them for users; identify visitors on the AYJ Courier Service‘s platform; carry out research on our users’ demographics and behaviour; provide you with information we think you may find useful or which you have requested from us, including information about our and services, provided you have indicated that you have not objected to being contacted for these purposes;

When you provide us with your personal information through the AYJ Courier Service’s platform, we will also use your personal information to send you marketing and/or promotional materials about our services from time to time. You can unsubscribe from receiving marketing information at any time by using the unsubscribe function within the electronic marketing material. We may use your contact information to send newsletters from us and from our related companies; and

In exceptional circumstances AYJ Courier Service may be required to disclose personal information, such as when there are grounds to believe that the disclosure is necessary to prevent a threat to life or health, or for law enforcement purposes, or for fulfilment of legal and regulatory requirements and requests. When using your Personal Data for the above purposes, we may contact you via regular mail, fax, e-mail, SMS, telephone or any other electronic means.

Disclosing User’s Personal Information

AYJ Courier Service may disclose the users’ personal information to the following parties

(including those located overseas) only for the purposes as stated above:

1. Agents and service providers who provide services relating to the purposes of which the personal information is collected including data processing services;
2. Our third-party service providers as we deem necessary or appropriate;
3. Any person, who is under a duty of confidentiality with AYJ Courier Service and who has undertaken the responsibility to keep such information confidential; and
4. Bank, financial institution, insurance companies, land authorities, Malaysian Inland Revenue Board, Companies Commission of Malaysia, and court of laws.

AYJ Courier Service will not disclose the user’s personal information to unaffiliated third parties without the user’s consents unless such personal information is required by law or in good faith and such action is necessary to comply with any law enforcement agency requirements, court orders or legal processes.

In addition, AYJ Courier Service will not sell, trade or rent users’ personal information to others.

Personal Data Retention

Any personal data supplied by you will be retained by AYJ Courier Service as long as it is necessary and expedient for the fulfilment of any purpose as stated above pursuant to our internal practices, regulatory requirements, legal and accounting requirements.

Your Obligations

It is your obligation to supply your personal data to us in the most accurate manner. If you do not provide us with your personal data, we are unable to, process your personal data on your behalf, for the purposes stated in this Notice, or effectively render our services to you and all relationships created or to be created between us shall then be terminated and ceased to be in effect immediately.

If you do not wish for your personal data to be collected via cookies on this website, you may deactivate cookies by adjusting your internet browser settings to disable, block or deactivate cookies, by deleting your browsing history and clearing the cache from your internet browser.

Your Data Protection Rights

AYJ Courier Service would like to make sure that you are fully aware of your data protection rights. Every user is entitled to the following rights:

Right to request access to personal data

Subject to a payment of small fee, you are entitled to request access to your personal data that is processed by us with reasonable notice.

Right to request correction of personal data

You are entitled to request the correction of your personal data that is held by that is inaccurate, incomplete or out-of-date with reasonable notice.

Right to Erasure

You have the right to request AYJ Courier Service to erase your personal data under certain conditions.

Right to restrict processing

You are entitled to limit our processing of your personal data by expressly withdrawing in full your consent given previously including for us to send any advertising and marketing materials or for direct marketing purposes subject to any applicable legal restrictions, contractual conditions and within a reasonable time period.

The right to object to processing

You have the right to object to AYJ Courier Service’s processing of your personal data, under certain conditions.

The right to data portability

You have the right to request AYJ Courier Service to transfer the data that we have collected to another organisation, or directly to you, under certain conditions.

Changes to this Notice

AYJ Courier Service reserves the right to amend or update this Notice at any time to reflect changes in the law, our business practices, processes or structure. Upon the update or amendment, AYJ Courier Service will post a notification on the site or in the app and revise the updated date accordingly. The user acknowledges and agrees that it is the user’s responsibility to review this Notice periodically and be aware of future modifications. By continuing to communicate with AYJ Courier Service or by continuing to use AYJ Courier’s services following the modifications, updates or amendments to this Notice, it shall signify your acceptance of such modifications, updates or amendments.
